CUM – AUCTION NOTICE OF CONDEMNED VEHICLES TERMS
& CONDITIONS On behalf of the President of India, sealed tenders are invited by the Commissioner of Central Excise, No.1, Goubert Avenue, Puducherry 605 001 for purchase of 2 Nos. condemned Motor Vehicles and other Misc. motor vehicle scrap items belonging to Commissioner of Central Excise, Puducherry Commissionerate in as-is-where-is condition as detailed below : (1)
The date & time upto which tender schedules could be obtained, form the above address, the dates & time upto which the sealed covers will be received in the above address and the dates and time of opening of sealed tenders / auction are indicated above against each. The tender received after the due date and time will not be accepted. (2) SEALED COVER The sealed tender offering the rate for the purchase of each of the condemned vehicles should be addressed to the COMMISSIONER OF CENTRAL EXCISE PUDUCHERRY COMMISSIONERATE in the sealed cover enclosed with the following superscription “TENDER FOR THE PURCHASE OF CONDEMNED VEHICLES REGN NO. __________________________” The envelope should also bear the name, address and seal (if available) of the tenderer. (3) EARNEST MONEY DEPOSIT A) An Earnest Money Deposit by way of Demand Draft / Bankers Cheque for the value as prescribed above for each vehicle drawn on any nationalized scheduled bank payable at Puducherry in favour of COMMISSIONER OF CENTRAL EXCISE, PUDUCHERRY should be invariably enclosed along with each tender. Tender offered without the EMD fixed will be summarily rejected. B) The EMD will be returned to the unsuccessful tenderer immediately after finalization of the auction. After opening the tender, if the EMD is found to have been paid less than what is prescribed, it will result in the rejection of the tender. (4) TENDER FORM The tender amount should be quoted only in the prescribed tender schedule enclosed. Rates quoted in any other form will be rejected. FOR EACH VEHICLE AND SCRAP ITEMS SEPARATE TENDER SCHEDULE PRESCRIBED SHOULD ONLY BE USED. If rates for more than one vehicle is quoted in the same tender schedule, the tender will be rejected. (5) INSPECTION
A) The condemned vehicles to be auctioned is available for inspection by the tenderer at the specified location between 11.00 hrs and 16.00 hrs on all working days upto 19/08/2010. The name and address and telephone Nos. of the contact official are also indicated in the tender form. B) The tenderer must get satisfied of the conditions and quality of the vehicle to be purchased before offering the tender rate. (6) TENDER OPENING: a) Tenders will be received only upto the date and time prescribed in para
(1). All the tenders received will be
opened at 17.00 Hrs. on 25/08/2010 by the Tender Committee at the Office of
the Commissioner of Central Excise, b) If the day of opening of the tenders happens to be a holiday, the same will be opened on the next day at 17.00 Hrs. (7) ACCEPTANCE The tenderer should quote the rate for purchase of the condemned vehicles both in words and in figures. If there is any difference in the figures and that in the words, the rate quoted in words will only be taken into account. The upset price as fixed by the APPROPRIATE AUTHORITY placed in a sealed cover will be opened at the time of opening of tenders and will be the minimum price for acceptance of the highest bidder. (8) SALES TAX Appropriate sales tax admissible will be collected over and above the sale price in accordance with the Sales Tax Act / Rules in force. As such the tenderer should quote the rate exclusive of sales tax while offering the rate in the tender. (9) PAYMENT A) Upon finalization and acceptance of the highest bid amount, the successful tenderer should remit on the spot 50% of the highest bid amount and the remaining 50% plus sales tax should be paid within 24 Hours from the time of conclusion of the tender, failing which the entire EMD and the amount already remitted will be forfeited to Government accounts in full. B) The initial 50% payment should be made in cash and the balance 50% plus sales tax made either by cash or by Demand Draft drawn on any nationalized / scheduled bank in favour of the Commissioner of Central Excise, Puducherry C) The condemned vehicle will be released for delivery to the successful tenderer only after the full payment of the entire bid amount including sales tax, to the Commissioner of Central Excise, Puducherry (10) DELIVERY After complete payment, and on receipt of delivery authorization from the Commissioner of Central Excise, the successful tenderer should remove the condemned vehicle at his own risk and his own cost within 24 Hours from the time of payment of the entire bid amount with due sales tax, failing which a ground rent of 1% of the highest bid amount will be collected extra, for each day. (11) LOSS OR DAMAGE Once the tender is finalized and the entire bid amount collected, and delivery authorization issued, this office will not be responsible either for safe custody or for any loss or damage of the vehicles, beyond 24 hours on finalization of tender. (12) OTHER CONDITIONS a) The highest tenderer is responsible for all acts done either by himself or by his authorized representatives. b) In case of any dispute, it should be clearly understood that the decision of the Tender Committee shall be final. c) The Tender Committee reserves all rights to accept or reject any tender or all without assigning any reason thereof and the decision of the Tender Committee will be final and binding on all. d) The highest bid once accepted is not transferable to any one. e) The tenderers are strictly forbidden to indulge in any group discussion or quarrel inside the Tender Hall during the opening of tender. If found violative, they will not be allowed to participate in the tender and sent out of the Hall instead. f) All the tenderers are deemed to have read and accepted the terms and conditions herein mentioned.
